AFRICA CINEKIT RENTALS – TERMS AND CONDITIONS

Please read these terms carefully as they contain important information regarding your legal rights, remedies, and obligations.

These Terms and Conditions (“Terms”) govern all rentals, use of equipment, and engagement with Africa CineKit Rentals. By renting equipment, using our website or communication channels, signing a rental agreement, or interacting with any services offered by Africa CineKit Rentals, you are agreeing to be bound by these Terms in full, without modification or exception. When you sign up as a Member of the Platform, you must agree to Africa Cinekit Rentals Terms & Conditions, and Privacy Policy when prompted.

1. WHO WE ARE

Africa CineKit Rentals is a Nairobi-based equipment rental service offering professional film, photography, and production gear for creators, filmmakers, studios, and production companies. We support productions of all scales across Kenya and East Africa, ensuring high-quality, reliable equipment and experienced customer service. Our contact number is +254 701 564 444.

2. ENGAGEMENT & ACCEPTANCE OF TERMS

By engaging with Africa CineKit Rentals—whether by placing a rental order, receiving gear, or using any part of our service—you acknowledge and agree to abide by these Terms. This includes any associated policies referenced herein, including our Privacy Policy and Community Guidelines, which may be updated from time to time at our discretion.

3. RENTAL PERIOD

Our standard rental period is defined as a single day consisting of 8 to 10 hours. We charge per day, not per hour. Regardless of how long the gear is used within the day, the full daily rental rate applies. There are no partial-day rates. Late returns may result in an additional full-day charge or penalty.

Rental begins the moment the gear leaves our premises and ends when it is returned and checked back in. If gear is delivered to you, the rental period still starts from the agreed handover time.

4. BOOKINGS, DEPOSITS & CANCELLATION

All bookings must be confirmed in advance. A deposit may be required to secure gear. Deposits are non-refundable in case of cancellations within 24 hours of pickup or delivery. Africa CineKit Rentals reserves the right to cancel or deny rentals if terms are violated, false information is provided, or payment is delayed.

5. CONDITION OF EQUIPMENT

All equipment is checked, tested, and maintained to professional standards before and after each rental. You are responsible for inspecting all equipment upon receipt. By accepting delivery or collecting the gear, you acknowledge it is in satisfactory working condition.

You are required to notify Africa CineKit Rentals immediately if any equipment is found faulty, damaged, or missing within 30 minutes of pickup or delivery. Failure to do so implies your full acceptance of the gear’s condition and your responsibility for it.

6. LOSS, THEFT OR DAMAGE

Once the equipment is in your custody, you are fully responsible for its safekeeping and proper use.

In the event of any loss, theft, or damage, regardless of cause or circumstance, you agree to pay the full new replacement value of the equipment. This is non-negotiable and payable in full within 7 days of notice. Repair costs (if applicable) will be assessed by Africa CineKit Rentals, and in cases where repair is not viable, full replacement cost applies.

If equipment is stolen while in your care, a police abstract must be submitted immediately. However, this does not absolve you of financial liability.

7. INSURANCE & LIABILITY

We recommend all renters obtain adequate insurance to cover the replacement value of the gear. Africa CineKit Rentals does not provide coverage for third-party use, and all liability for gear lies with the hirer during the rental term.

Africa CineKit Rentals shall not be liable for any indirect, incidental, or consequential losses, including loss of income or production delays due to faulty equipment or late delivery. While we do our best to prevent such incidents, you agree to rent at your own risk and responsibility.

8. USE & RESTRICTIONS

You may not:

Sub-rent or transfer possession of any gear to third parties.
Take equipment outside Kenya without written consent.
Use gear in hazardous or extreme environments without prior approval.
Tamper with internal mechanisms, labels, serial numbers, or protective seals.

You must ensure proper handling, storage, and use of all gear. Cables, lights, lenses, monitors, batteries, and accessories must be returned in the same clean and functional condition.

9. RETURNS

All gear must be returned within the agreed rental term. Late returns are charged per full day and may incur penalties or affect future rentals.

Gear must be returned in the condition it was received. Dirty, dusty, or damaged items may incur cleaning or repair fees.

10. PAYMENT TERMS

Payment is due in full upon pickup or delivery unless otherwise agreed in writing. Africa CineKit Rentals reserves the right to withhold delivery until full payment is made.

If credit terms are extended, invoices must be settled within the agreed period. Late payments may attract interest and result in future rental restrictions or legal recovery measures.

11. TERMINATION OF AGREEMENT

Africa CineKit Rentals may terminate any rental agreement immediately if:

You breach any clause in these Terms
Payment is delayed or fraudulent
Equipment is mishandled or endangered
You become insolvent, bankrupt, or subject to legal proceedings

In such cases, we reserve the right to repossess the gear without notice and hold you liable for damages, replacement costs, and loss of income.

12. PRIVACY

We may collect and store data related to your rentals, communications, and transactions. This is used solely for operational, security, and customer support purposes and is not shared with third parties unless required by law. For more information, refer to our Privacy Policy.

13. DISPUTES & GOVERNING LAW

These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from or relating to these Terms will be subject to the jurisdiction of Kenyan courts. Africa CineKit Rentals reserves the right to pursue damages and recovery of costs through any legal means necessary.

14. FINAL NOTES

We take pride in supporting the local film and media industry with reliable, well-maintained gear and professional service. We ask that you treat our equipment with respect and communicate clearly about any issues.

By renting from Africa CineKit Rentals, you agree to these Terms in full. If you do not agree, do not proceed with any rental.
